Student Terms and Conditions

Only Students, who agree to this Terms and Conditions (hereinafter shown as “the Agreement”) may use the services of BBenny study.
Welcome to BBenny study!
These Terms and Conditions set forth the rules and instructions for the use of the BBenny study website located at https://bbenny-study.online. These Terms constitute a public offer.
Use of the website constitutes acceptance of these Terms either through registration or through actual use of the Service.
Use the Service:
Use of the BBenny study service by persons under the age of 16 is permitted only with the consent of their parents or legal guardians.
Parents or legal guardians are responsible for the actions of minor users, including payment for services and compliance with this Agreement.
Cookies:
The website uses cookies to help personalize your online experience. By accessing BBenny study, you agreed to use the required cookies.
A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.
1. Definitions
1.1. The following terms and definitions shall apply in this Agreement:
a. “Website”: the website located at the domain https://bbenny-study.online and all its subdomains.
b. “Lesson(s)”: a general term meaning instruction, useful information, exercises, communication, advice and recommendations provided in any form for the purpose of developing a student’s skills or enabling the student to acquire knowledge.
c. “Student(s)”: any person registered on our Website who receives or intends to receive Lessons through our Service.
d. “Tutor(s)”: any natural person registered on our Website who provides or intends to provide Lessons through our Service.
e. “Lesson Agreement”: an agreement concluded between a Tutor and a Student setting out the terms and conditions for conducting Lessons.
f. “Lesson Price”: the price of a Lesson paid by the Student to the Tutor.
g. “Tutor Search Services”: services provided through the Website that facilitate interactions between Tutors and Students when exchanging Lesson Agreements.
h. “Service” or “our Services”: the set of services provided through the Website, including Tutor Search Services.
i. “Tutor Search Fee”: the fee for Tutor Search Services paid by the Student to the Company.
j. “Service Price”: the total amount consisting of the Lesson Price and the Tutor Search Fee.
1.2. Services provided through our Site include the following:
– Student services aimed at facilitating the search, and management of lessons and also to facilitate the exchange of lesson agreements.
– Matching service
– Counselling and advice related to the services above.
– Lesson services for Students.
– Distribution of information related to but not limited to; campaigns, services and updates sent through email.
– Tutor services aimed at facilitating the exchange of lesson agreements and management of lessons.
– Other services deemed appropriate by the Company.
1.3. This Agreement applies to use of services by Students.
Aside from this agreement, the Student Terms, any other regulations on our Site and any notices sent to Students will be treated as part of this agreement.
1.4. The Company shall communicate any information it deems appropriate to Students and Tutors using emails, attachments and notifications posted through the Site or by whatever means appropriate.
2. Use of the Services and Payment
2.1. Students independently evaluate the quality, accuracy, reliability, and usefulness of Lessons provided by Tutors and agree to fulfill their obligations as users. The Company does not guarantee the reliability, accuracy, validity, or usefulness of the personal information of Tutors or other information provided by Tutors.
2.2. Before booking a Lesson, the Student must carefully review the information about the Tutor. If any questions or doubts arise regarding the Tutor’s identity or the content of the Lesson, the Student must ask a question on the Website (on the Tutor’s page). Students acknowledge in advance that each teacher may have a different pronunciation.
2.3. Lessons are conducted only by Tutors. The Company does not conduct Lessons except in cases deemed necessary by the Company.
2.4. The Company does not access Lessons, does not manage Lessons provided by Tutors, and does not participate in the exchange of information between Tutors and Students.
2.6. The Company takes reasonable measures to verify user profiles.
2.7. The Company is not responsible for the exchange of information, files, or goods between Students and Tutors.
2.8. All lessons are booked exclusively through the calendar on the BBenny study website.
Tutors independently set available time slots in their calendars.
A Student may book a lesson:
– in any available slot;
– no later than 12 hours before the lesson begins.
After booking, the selected time slot is automatically reserved. A lesson is considered confirmed only after successful payment.
Agreements made outside the platform’s booking system (for example, verbal agreements or private correspondence) are not considered official lesson bookings.
2.9. BBenny study Lesson Cancellation Policy
Before confirmation of the request by the tutor, the student may cancel the lesson at any time without charge.
More than 3 hours before the start of the lesson – cancellation is possible at any time.
Less than 3 hours before the start of the lesson – the tutor may charge a cancellation fee.
If the student fails to attend the lesson, the tutor may charge the lesson fee.
If the tutor is unable to conduct the lesson for a valid reason, the lesson shall be rescheduled to another agreed time or the funds shall be refunded to the Student.
2.10. Payment for services is carried out through payment systems integrated into the website. Available payment methods may include:
– bank cards (Visa, MasterCard, MIR), Faster Payments System (SBP) via the Payture system (OOO “Platezhny”);
– Wise;
– Alipay.
All payments are processed through a secure SSL connection. After successful payment, the user receives confirmation at the email address provided.
If payment cannot be successfully processed due to card expiration, insufficient funds, or other reasons, and you do not cancel your account, the Company may suspend your access to the Website until payment is received.
2.11. Refund Policy. Refunds are possible in the following cases:
– if a technical error occurred during payment;
– in case of erroneous payment (upon written request by the user).
To request a refund, the user must send an email to info@**********dy.online indicating:
– full name;
– the email address used for payment;
– date and amount of payment;
– reason for the refund request.
Funds will be returned to the same payment method used for the purchase within 5-10 business days after confirmation of the request.
BBenny study reviews requests for early cancellation or account termination in accordance with the refund policy.
3. Issues and Conflicts with Other Students
3.1. In the event of any conflict between a Student and other Students, Tutors, or third parties, or if any damage is caused, all involved parties shall make reasonable efforts to resolve such issues between themselves using their own resources.
4. Student Registration
4.1. Students submit a registration request by completing the form on the student registration page, providing their name, email address, chosen password, country of residence, and other information specified by the Company in the form, and then submitting the form to the Company or by any other method provided by the Company (hereinafter referred to as the “Student Registration Application”). The application must be completed only by the Student and may not be completed by a third party, except in cases permitted by the Company.
4.2. Students must not provide inaccurate information in the Registration Application.
4.3. The Company accepts Student Registration Applications via email or by other methods specified by the Company.
4.4. The Company may reject a Student Registration Application without explanation in the following circumstances:
a. The application was clearly submitted by a third party rather than by the Student (except in cases permitted by the Company).
b. The application lacks necessary information or contains inaccurate information.
c. The student’s registration was previously terminated due to violation of these Terms and Conditions.
d. If the Company considers it impossible for the student to continue using the service after the student has been blocked by more than two (2) tutors.
e. In other cases where the Company considers it inappropriate to accept the Student Registration Application.
4.5. In case of a change in the name, e-mail address, country of residence and any other information after submitting the Application for Registration, the Student must inform the Company about it.
4.6. Inactive Accounts. If a student does not book any lessons for a period of 2 months, the Company reserves the right to delete the student’s account. The student will receive an email notification 7 days prior to the account deletion. The student has the right to register again without any restrictions.
5. Password Use
5.1. The Student may create their own password or use a password provided by the Company (hereinafter referred to as the “Password”) to access restricted sections of the Website. The Company is not responsible for password management.
5.2. The Student must not transfer or disclose their Password to third parties. The Company is not responsible if the Student or any other person improperly uses the Password or causes harm to a third party.
5.3. If the Student becomes aware that their Password has been used by a third party without consent, the Student must immediately notify the Company and follow its instructions.
6. Burden of Expense
6.1. Students are responsible for preparation of hardware (such as computer, headset and microphone, etc.), and software, Internet connection and other things which are necessary for using the services and lessons at their own expense.
6.2. Students understand that use of the services and lessons requires communication expenses such as telephone charge, Internet connection fee, electricity fee and any other costs other than those stipulated in the previous paragraph and they are responsible for all expenses.
7. Prohibited Activity
7.1. Students may not commit any of the following in the use of the service or lessons:
a. to send or post false information.
b. to falsify or delete information that may be used for the services or to attempt this.
c. to infringe on the intellectual property right of other students, tutors, a third party or our Company such as copy right or trademark right, or any attempts to do so.
d. to practice discrimination or mental abuse towards other students, tutors, a third party or our Company, or any attempts to slander honor or credibility of other students, a third party or BBenny study.
e. Any attempts to infringe on heritage, privacy, portrait rights or publicity of other students, tutors, other third parties or our Company.
f. to send advertising or soliciting emails, without prior permission, to other students, tutors, other third parties or our Company, to send emails that would give a feeling of disgust, to interrupt mail reception of others, to request a third party to forward chain-reaction emails, or to forward such emails complying with requests.
g. to conduct any action that would lead to crimes such as fraud.
h. Engage in activities which purpose is to solicit individuals to join a particular religion, political organization or multi-level marketing scheme.
i. to send or post any image or document which may be pornographic or involve child abuse.
j. to conduct election campaigns or similar activities, or to violate public office election law.
k. to use or provide harmful programs such as computer viruses, or to promote such programs to third parties.
l. to attempt any unauthorized access to other computer systems or networks which are connected to the services.
m. to violate laws or to be offensive to public order and morals (including but not limited to prostitution, violence or savagery) in addition to the previous paragraph, or to put other users, tutors, third parties or our Company at a disadvantage.
n. to compete with other students, tutors or third parties of the services, or to introduce or to render others a service which can be competitive to us.
o. Creating multiple accounts for the same user
p. Use intimidation or violence in connection with transactions.
q. to cause anxiety and discomfort to other lesson participants including the tutor by wearing inappropriate articles of clothing such as underwear, swimsuits, or anything that excessively exposes oneself.
r. to excessively abuse or hurt others including students and tutors; to violate their dignity; or to engage in otherwise inapporpriate behavior.
s. to film or record lessons and events without the permission of the tutor or BBenny study.
t. Any other behavior that our company deems inappropriate
7.2. Students may not use information about Tutors obtained through the Service for purposes unrelated to the use of the Service or performance of Lesson Agreements. Students may not contact Tutors directly to arrange lessons outside the Service.
7.3. Any person who is a relative, partner, or cohabiting partner of a Tutor is considered a “close partner” and must obtain permission from the Company before booking lessons with that Tutor. If it is discovered that a Tutor has conducted lessons with a close partner without prior permission from the Company, such lessons and any related reviews will be cancelled.
8. Emails and Uploaded Information
8.1. Our Company shall not be liable for contents of any emails, or uploaded information which are created by students, tutors or other third parties.
8.2. Students shall take responsibility for emailing, uploaded information, handling email service providers, and other related conditions, guarantees and statements. Students agree to hold our Company blameless against any kind of loss or damage, resulting from related correspondences.
8.3. Our Company provides email newsletter services when our Company deems necessary. Students agree beforehand that our company may or does not provide email newsletter services. Students may refuse to receive email newsletters by taking a procedure that our company stipulates.
9. Confidential Information
9.1. Students provide personal data upon request by the Company and any other information required under this Agreement for the use of the Service, conducting Lessons, and student registration.
9.2. Students must maintain the confidentiality of any information about other students, tutors, third parties, or the Company obtained through the use of the Service both during and after termination of their registration.
9.3. Students must not disclose information about the Service if such disclosure could cause harm to the operation of the Service.
10. Warranties
10.1. The Company shall not be liable for:
– actions of Tutors or Students;
– indirect damages;
– loss of profit.
This limitation does not apply in cases of intentional misconduct or gross negligence.
11. Languages
11.1. These Terms may be published in several languages. In the event of a dispute, the version in the language of the Tutor’s country of residence shall apply unless otherwise agreed by the parties.
12. Consultation Settlement
12.1. In the event of disputes related to these Terms that are not clarified in this document, such disputes shall be resolved through negotiations between the Students and the Company in good faith.
12.2. This Agreement is governed by the rules of private international law and shall be applied taking into account the consumer protection laws of the user’s country.
The Company reserves the right to update these Terms. The updated version shall enter into force upon publication on the Website.
