Only Tutors, who agree to this Terms and Conditions (hereinafter shown as “the Agreement”) may teach and use the services of BBenny study.

These Terms and Conditions outline the rules and regulations for the use of BBenny study’s Website, located at https://bbenny-study.online
By accessing this website, we assume you accept these Terms and Conditions. Do not continue to use BBenny study if you do not agree to all of the Terms and Conditions stated on this page.
Required Qualifications for Using the Service
A Tutor must be at least 18 years of age and possess the necessary knowledge and skills to provide educational services.
Tax Obligations
Tutors are solely responsible for declaring their income and paying taxes in their country of residence.
For residents of the European Union, the Company may request tax information in accordance with the requirements of DAC7 regulations.
Personal Data
The Company processes the personal data of Tutors and Students in accordance with applicable data protection laws, including the GDPR for users located in the European Union.
Cookies
The Website uses cookies only with the user’s consent. Users may accept or decline the use of cookies and may change their cookie preferences at any time.
A cookie is a text file placed on your hard disk by a web page server. Cookies cannot be used to run or spread malicious programs or viruses on your computer.
1. Terms and Definitions
1.1 The following terms are used in this Agreement:
a. “Website” – the website located at https://bbenny-study.online and all its subdomains.
b. “Lesson(s)” – a general term meaning instruction, educational information, exercises, communication, advice, and recommendations provided in any form for the purpose of developing skills or acquiring knowledge.
c. “Student(s)” – any individual registered on our Website who receives or intends to receive Lessons through our Service.
d. “Tutor(s)” – any individual registered on our Website who conducts or intends to conduct Lessons through our Service.
e. “Lesson Agreement” – an agreement concluded between a Tutor and a Student defining the conditions for conducting Lessons.
f. “Lesson Price” – the price of a Lesson paid by the Student to the Tutor through BBenny Study.
g. “Tutor Matching Service” – services provided through the Website that facilitate interaction between Tutors and Students when entering into Lesson Agreements.
h. “Service” or “Our Services” – the set of services provided through the Website, including the Tutor Matching Service.
i. “Tutor Matching Fee” – the fee for the Tutor Matching Service paid by the Student to the Company.
j. “Service Price” – the total amount consisting of the Lesson Price and the Tutor Matching Fee.
1.2 Services provided through our Website include:
– hosting tutor profiles
– tutor matching services
– consultation and recommendations regarding the above services
– services related to conducting Lessons for Students
– distribution of information about campaigns, services, updates, etc. via email
– other services that the Company considers appropriate
1.3 This Agreement governs the use of the Service by Tutors.
In addition to this Agreement, the Company applies the Terms of Use, other Website policies, and notices sent to Tutors (collectively referred to as the “Terms of Use”), which form an integral part of this Agreement.
1.4 The Company may communicate information it considers relevant to Students and Tutors via email, notices on the Website, or other appropriate communication methods.
2. Use of the Service
2.1 Tutors independently evaluate the quality, accuracy, reliability, and usefulness of the information and services provided by the Company and agree to assume responsibility for their use.
2.2 BBenny Study is not the employer, agent, or representative of the Tutor. Therefore, no employment relationship exists between the Tutor and the Company.
2.3 By using the Service, Tutors agree to always prioritize the needs of Students and provide the best possible service.
2.4 The Company strives to maintain a favorable learning environment for Students.
If the Company determines that a Lesson, related communication, or the quality of teaching does not meet the standards described in clause 2.3, the Company reserves the right to cancel the Lesson payment in case of justified Student complaints or violations of these Terms.
Whenever possible, the Company will notify the Tutor and provide an opportunity to explain.
2.5 Lessons are conducted solely by Tutors and not by the Company, except in cases where the Company considers it necessary.
2.6 The Company may, but is not obligated to, monitor Lessons or communications between Tutors and Students.
2.7 The Company does not guarantee the reliability of Tutors, Students, or the information they provide through the Website.
2.8 The Company is not responsible for unlawful actions committed by Tutors or Students through the Service.
2.9 The Company is not responsible for any information, files, or goods exchanged between Tutors and Students. Tutors and Students release the Company from liability for any damages or losses resulting from such exchanges.
2.10 Tutors must not exchange files or goods unrelated to Lessons without the Company’s permission.
3. Disputes with Other Tutors
If damage arises from a conflict with another Tutor, Student, or third party, the involved parties must resolve the matter independently.
If the Company suffers losses due to such disputes, it may seek compensation from the responsible parties. Such compensation may include reasonable legal costs.
4. Tutor Registration
4.1 You may apply to conduct Lessons by completing and submitting an application form on the Website.
The application must be completed personally and contain accurate and truthful information.
4.2 The Company will notify you via email whether your application has been accepted or rejected.
4.3 The Company may refuse registration if:
– the application was submitted by a third party (unless approved by the Company)
– the application contains false, inaccurate, or incomplete information
– the Tutor’s registration was previously terminated for violation of these Terms
– the Company determines that accepting the application is inappropriate
4.4 If a Tutor changes their name, email address, country of residence, or other information after registration, they must notify the Company.
5. Suspension or Termination of Tutor Accounts
The Company may suspend access to the Service or remove a Tutor profile.
In cases of serious violations (fraud, illegal activity, security threats), this may occur without prior notice.
This may include situations where:
– the Tutor violated these Terms
– actions listed in Section 11 were committed
– the Tutor failed to attend more than three Lessons per quarter
– the Tutor’s behavior toward Students does not comply with clause 2.3
– the Tutor’s activity may negatively affect the reputation of the Service
6. Use of Password
6.1 Tutors may create their own password or use a password provided by the Company.
6.2 Tutors must not share their password with third parties.
6.3 The Company is not responsible for any misuse of passwords.
6.4 Tutors must notify the Company immediately if they suspect unauthorized use of their account.
7. Costs and Equipment
7.1. Tutors are responsible for preparation of hardware (such as computer, headset and microphone, etc.), and software, Internet connection and other things which are necessary for teaching and using the services at their own expense.
7.2. The expenses such as telephone charge, Internet connection fee, electricity fee and any other costs other than those stipulated in the previous paragraph must be paid by tutors themselves.
8. Lesson Fees
8.1. You agree to give the Company the right to collect Lesson Fees from Students, and if necessary refund Lesson Fees on your behalf.
8.2. You will indicate on your profile the Cost of your lessons (herein after referred to as “Service Costs”) within the range permitted by the Company.
8.3. Your Lesson Fee shall be equivalent to 70% (or whatever higher percentage defined as the Tutor’s “Margin Rate”) of the Service fee.
8.4. For Tutors receiving payments via Wise:
– A Tutor may request payment for the lessons conducted only if their account balance exceeds 100 USD (one hundred United States dollars). Upon receiving a payment request from the Tutor, the Company shall calculate the total amount due for the completed lessons and transfer the funds to the Tutor’s designated Wise account. The Company covers all transfer fees only for payments made between the 5th and 10th day of each month. If the Tutor submits a repeated request for payment, they shall bear the cost of the transfer commission. The Tutor shall also bear any other related expenses, including fees or interest for receiving or withdrawing funds.
For Tutors receiving payments via Alipay, SBP, or Bank Cards (Visa issued in Russia):
– A Tutor may request payment for the lessons conducted no more than once per week. Upon receiving the Tutor’s payment request, the Company shall calculate the total amount due for the completed lessons and transfer the funds to the Tutor’s designated bank card in Russian rubles.
The Tutor shall bear all other related expenses, including any bank service fees or withdrawal charges.
8.5 Payment requests must be submitted within 6 months after the Lesson date.
8.6 Payments may be withheld if:
– the Student requests a refund
– the Lesson was interrupted for more than 20% of its duration
– the Tutor violated the Terms
– payment information is incorrect
– a complaint investigation is ongoing
8.8 Lesson Fees shall be calculated and paid in US Dollars, Chinese Yuan, Euros or Russian Rubles, depending on the Tutor’s country of residence.
9. Lesson Agreement
A Lesson Agreement becomes effective when a Tutor accepts or confirms a lesson request on the Website.
Students may cancel Lessons according to the Cancellation Policy.
Tutors must follow the cancellation rules when accepting, rejecting, canceling, or rescheduling Lessons.
10. Tutor Payments and BBenny Study Commission
It’s free to register at BBenny study, and we don’t charge a fee to host your profile. Commission is only charged when a tutor starts to get bookings from students.
10.1. The commission rate depends on the total number of lesson hours a tutor has taught on the platform. The commission for the FIRST lesson with a new student is 30%. For all the subsequent lessons, the tutor is charged a percentage of the hourly rate (between 16% and 23%). Detailed information about the commission rate is follows:
– 2 – 20 lessons the rate is 23%, i.e. when you conduct from 2 (two) to 20 (twenty lessons), 23% of the cost of the lesson will be deducted from you.
– 21 – 100 lessons the rate is 20%, i.e. when you conduct from 21 (twenty-one) to 100 (one hundred lessons), 20% of the cost of the lesson will be deducted from you.
– 101 – 300 lessons the rate is 18%, i.e. when you conduct from 101 (one hundred-one) to 300 (three hundred lessons), 18% of the cost of the lesson will be deducted from you.
– 301 and more lessons the rate is 16%, i.e. when you conduct from 301 (three hundred-one) and more lessons, 16% of the cost of the lesson will be deducted from you.
Most part of the commission is invested in bringing students to the Website, as well as website improvements and security improvements.
11. Prohibited Activities
11.1. You agree to not engage in any of the following activities while offering lessons through the Site:
a. Offer services which require accredited licenses such as (but not limited to) the offering of legal or medical services without qualification.
b. Offer services or perform actions that are criminal or discriminatory in nature.
c. Offer services or perform actions that are offensive to public order and established morals.
d. Offer services or exchange information of any kind that is obscene or pornographic in nature.
e. Promote or sell items that are not related to the lessons being offered.
f. Engage in activity that infringes, or has the possibility of infringing on the rights, property or privacy of other Students, Tutors or the Company.
g. Post or send information that is not correct.
h. Delete, tamper, falsify or attempt to inappropriately change information used for our services.
i. Engage in activity or use information that violates, or has the possibility of violating copyrights, trademark rights or intellectual property rights belonging to a third party.
j. Make false accusations, discriminatory, damaging or hurtful statements against another Tutor, Student, third party or the Company.
k. Send advertisements, promotional messages, chain-mail, invitations or any other mail to other Tutors, Students, third parties or the Company which may be construed as unwarranted, unsolicited or offensive.
l. Engage in activities which purpose is to solicit individuals to join a particular religion, political organization or multi-level marketing scheme.
m. Use or disseminate computer viruses.
n. Use someone else’s identity or pretend to be another Tutor.
o. To attempt any unauthorized access to other computer systems or networks which are connected to the services.
p. To violate laws or to be offensive to public order and morals (including but not limited to prostitution, violence or savagery) in addition to the previous paragraph, or to put other tutors, students, third parties or our Company at a disadvantage.
q. To introduce or solicit usage of services that directly compete with, or potentially compete with our service to other tutors, students and other third parties using the site.
r. To encourage or promote any of the mentioned behaviors or any other behavior that our company deems inappropriate
11.2. You are not permitted to place requests to yourself. Furthermore, any person who is a relative, partner or cohabitant of yours (hereinafter referred to as a ‘close-affiliate’) is required to seek permission from the Company before taking lessons from you. If you are found to have illicitly placed requests to yourself, or to have delivered lessons to a close affiliate without prior permission from the Company, those lessons will be annulled together with any associated feedback and both your and the close-affiliate’s accounts may be subject to immediate closure. Any fees you gained from those requests will be forfeit and those that have been paid out must be refunded to the company. The Company shall use reliable, evidence-based data in determining whether or not a particular student account is yours or a close affiliate’s.
11.3. Your account may be terminated promptly and without warning if it is found that you have participated in a crime; have engaged in violent, threatening or fraudulent acts; or have promoted discrimination and/or violence at any time in the past, within or outside of BBenny study, and the information leading to those conclusions is found to be true to a reasonable degree according to the standards which we set.
11.4. Tutors shall not use any information obtained through using the services about students for any other purposes than use of the services or practice of the lesson contract concluded by our matching services. Tutors shall not provide any lessons directly to students without using the Site services.
11.5. In order to avoid misunderstandings with students or parents, tutors should follow the below mentioned standards during lessons:
a. The camera must be turned on during the lesson. Make sure your face is visible, illuminated and in the frame.
b. Tutors must wear suitable clean clothes (no overly bright/colorful/festive clothes, dressing gowns, pajamas and disheveled hair).
c. The background must be neutral and neat. If tutor’s background is very distracting, we recommend using a virtual background. Make sure that there is no loud noise, other people talking in the background, or constantly passing by you. It is not allowed to teach in public places (for example, in a cafe, library or on the street).
d. Tutors mustn’t eat or smoke during the lesson. Tutors shouldn’t drink alcohol immediately before or during the lesson. Drinking water from a mug or glass is allowed.
e. Tutors mustn’t invite other people to participate in their lessons. Tutors mustn’t ask students about other lessons or tutors, as this may confuse them.
12. Tutor Obligations
Tutors agree to:
– provide accurate and updated information
– deliver reliable and professional lessons
– comply with cancellation rules
– declare and pay applicable taxes
13. Confidential Information
Tutors must not disclose confidential information about Students, Tutors, or the Company obtained through the Service.
Such information may only be used to fulfill Lesson Agreements.
14. Limitation of Liability
The Company is not responsible for:
– actions of Tutors or Students
– indirect damages
– loss of profits
This limitation does not apply in cases of intentional misconduct or gross negligence.
15. Language
These Terms may be published in multiple languages.
In case of disputes, the version applicable to the Tutor’s country of residence or agreed by the parties shall prevail.
16. Dispute Resolution
Any disputes arising from these Terms shall be resolved through consultations between the parties.
The Company may update these Terms at any time.
The updated version becomes effective upon publication on the Website.
